Public Records Request

Public records maintained by the California Workforce Development Board (CWDB) are available for public inspection, unless they are exempt from disclosure by law, pursuant to the Public Records Act (PRA) contained in California Government Code section 7920.000, et seq.

In order for us to located requested records, you must clearly describe an indefinable record. If your request is unclear, we can assist you in making a focused and effective request. Whenever possible, your request should include:

  • Names of programs, projects, workforce regions, and the specific records involved.
  • The date or date range when the records were published

WHAT ARE PUBLIC RECORDS?

The PRA defines “public records” to include all written and recorded records in a public agency’s possession unless the law exempts the records from disclosure. Printed and photocopied documents, internal and external correspondence, handwritten notes, computer data, electronic files, and audio and video recordings are all public records subject to disclosure unless they fall within an exemption. The PRA provides the public access to records the CWDB generates, and records created by others that the CWDB has in its possession. 

The CWDB is not required to prepare new records in response to a request or to compile, synthesize, summarize, or index information or records in a form that does not exist at the time of the request. 

PROCESSING REQUESTS

We will generally notify you whether the CWDB has responsive, disclosable records within 10 days of your request. Under unusual circumstances, we may need up to 14 additional days to determine whether we have responsive, disclosable records. The law allows the CWDB to charge a fee for providing copies of its records. However, we can often provide electronic copies of records at no cost. We will notify you if fees will be collected prior to providing records. 

EXEMPT RECORDS

The Legislature has established that certain records may be exempt from public disclosure. These exemptions balance the public’s right to access public records against the individual right to privacy and the need for government to perform its duties. You can review the statutory exemptions at  California Government Code section 7922.000, et seq.
